STATE PESTICIDE-DISCHARGE PERMITS ARE NOT SUBJECT TO ENDANGERED SPECIES ACT REQUIREMENTS, JUDGE RULES ---- The plaintiffs in a closely watched suit argued that Oregon's discharge permit program had been federalized by virtue of EPA grants. Elmer Rauckman, a toxicologist advising the company, also says the Agency's recent decision to require a pesticide registration for the machine was expected the first time around.
