1)Inert Ingredients: Proposed Revocation of Tolerance Exemptions with Insufficient Data for Reassessment

EPA is proposing to revoke tolerance exemptions for a group of inert ingredients. The Agency is unable to make the safety finding required under the Federal Food, Drug, and Cosmetic Act (FFDCA) because basic toxicology studies are not currently available. EPA is proposing to revoke the exemptions for food use pesticide products with an expiration date two years from the publication of the final rule to allow for data development. It is possible that a small number of screening-level studies may be all that is necessary to show that health risks are not expected from these chemicals. Non-food use products are not affected.

By law, EPA is required by August 2006 to reassess the tolerances that were in existence on August 2, 1996. The revocation actions currently being proposed by the Agency contribute toward tolerance reassessment requirements under FFDCA section 408(q), as amended by the Food Quality Protection Act (FQPA) of 1996. This proposed rule would revoke 129 tolerance exemptions, which would be counted as completed tolerance reassessments as required by the August 2006 review deadline.

EPA provided advance notice of this proposed action to key stakeholders, including the US Department of Agriculture, the Chemical Producers & Distributors Association?s Surfactant Task Force, and CropLife America, as well as major registrants and grower groups.

Syngenta Seeds, Inc. submitted a petition to EPA requesting an extension to the existing temporary exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus Thuringiensis VIP3A Insect Control Protein. The temporary tolerance exemption will expire on May 1, 2007.
